PETITION FOR BROTHERS AND SISTERS OF US CITIZENS
US Citizens can petition their brothers and sisters along with their family members as derivative beneficiaries. This is an F4 preference category so generally the wait will be 13 to 20 years depending on the beneficiaries’ country of chargeability. A lot of clients get discouraged by the wait time in this category but I tell the clients that they should file it regardless of the wait time because time will pass no matter what. By filing the petition, you get to lock in the priority date. It will be beneficial as a plan B in case your brother or sister find no faster way to obtain their US Permanent Residency.
Even if you sibling finds no benefit in the future, their children under 21 years of age (your niece and nephews) will benefit as a derivative beneficiaries. Whenever there is an opportunity to petition a family member, you should take advantage of the opportunity.
When the priority date becomes current, you brother or sister can apply for permanent residency through the US Embassy overseas.
